										<content:encoded><![CDATA[<p style="text-align: left;"><strong>Change the Tax Code to Allow Deductions for Pro Bono Services</strong></p>
<p style="text-align: left;">Red Rooster Group is establishing a campaign called Deduct It! to change the IRS tax code to allow small businesses to claim a deduction for services they donate to registered 501(c)3 nonprofit organizations. We have created a blog to gain support for this issue: <a href="http://deductit.wordpress.com/">http://deductit.wordpress.com<span id="more-19143"></span></a></p>
<p style="text-align: left;">Goods that are donated are allowed to be deducted, but not services. Allowing this deduction will:</p>
<ol>
<li><span style="font-family: 'Lucida Grande CY';">Correct the fundamental discrimination against service businesses. </span></li>
<li><span style="font-family: 'Lucida Grande CY';">Create massive value for the nonprofit sector at a time when it needs it badly. </span></li>
<li><span style="font-family: 'Lucida Grande CY';">Encourage a culture of businesses contributing to the service sector. </span></li>
</ol>
<p style="text-align: left;">This is the start of a nationwide movement to form a coalition to change this code. We appeal to all small business owners and associations:</p>
<ul>
<li>Creative service firms (Design, advertising, public relations)</li>
<li>Consulting Firms (business, operations, marketing, strategic planning, fundraising, etc.)</li>
<li>Architecture &amp; Design Firms</li>
<li>Law Firms</li>
<li>Accounting and Financial Firms</li>
</ul>
<p style="text-align: left;">We are in the process of galvanizing national grassroots support from both business and the nonprofit sector, drafting the legislation, and soliciting political support and sponsorship.</p>
<p style="text-align: left;">This blog will explore the considerations relating to this issues including:</p>
<ul>
<li>What types of businesses or services the deduction will apply to (for example, for small businesses up to $500,000 in revenue, and incorporated business, as opposed to individuals volunteering their time as a volunteer)</li>
<li>The amount of deductions allowed and whether a cap is needed (most likely based on a percentage of gross sales).</li>
<li>The value of the service being claimed (perhaps based on a previous service offered).</li>
</ul>

<p style="text-align: left;">NY Governor Paterson admitted tough times for nonprofits, but pledged his support for the sector, while addressing the Not-For-Profit Leadership Summit on May 11, 2009 in Westchester. Here are some notes and highlights from his talk.<span id="more-19088"></span></p>
<p style="text-align: left;">We need to be honest about our finances: 30% of our finances come from Wall Street. The states are mandated to balance their budgets. With sound management we can survive this crisis. Although it will not be without further pain, we will see prosperity in the years to come.</p>
<p style="text-align: left;">Healthcare spending was counted as part of the state budget for the first time, and there are signs of improvements from other states. For example, all other states will show 8 to 10% increase in spending after the Recovery Act</p>
<p style="text-align: left;">The margin of survival is less than what the government is currently providing — we are nowhere without nonprofits and the services nonprofits provide.</p>
<p style="text-align: left;">He announced that New York was second state (after California) to create a cabinet-level position that focuses on service and civic engagement.</p>
<p style="text-align: left;">There were 360 billions hours of service donated by New Yorkers, mostly seniors, although 57,000 were young people, before high school graduation. The Service America Act will give $2 million to volunteerism in New York State.</p>
<p style="text-align: left;">
<p style="text-align: left;"><strong>QUESTIONS</strong></p>
<p style="text-align: left;"><strong>Nonprofits Getting Their Fair Share</strong></p>
<p style="text-align: left;"><strong>Q: Last year the seriousness of the effects of the fiscal crisis became evident, particularly affecting small nonprofits that couldn&#8217;t afford to hire lobbyists. What are the plans to reform the process?</strong></p>
<p style="text-align: left;"><strong>A:</strong> At the time I had a great fear that our budget deficits would hit catastrophic proportions. We increased the state allocation to social services for the first time in 8 years. There was a 35% increase of food stamps, and we invested more in homecare. We helped to expand COBRA to 36 months to help the mentally ill as well. We tried to maintain an even sacrifice, although we still shifted money from higher income care to community centers.</p>
<p style="text-align: left;">
<p style="text-align: left;"><strong>MTA Cuts</strong></p>
<p style="text-align: left;"><strong>Q: The new MTA tax will also impact nonprofits, this is a hardship, can nonprofits be made exempt from the tax?</strong></p>
<p style="text-align: left;"><strong>A:</strong> The MTA tax on the region in order to come up with the resources. I thought that was not the best solution. I thought the fairest solution would be the tolling sacrifice on some bridge to all the bridges. Other regional plan was the only plan to avoid the 28% increase in the fares. We also cut in 11 different subway lines. The school tax will be refunded to the districts. The nonprofits are under the same encumberance as the schools are, so it’s a slippery slope once you exempt one entity to exempt other. I invite nonprofits to come to Albany to discuss the cost to the state to replenish the tax</p>
<p style="text-align: left;">
<p style="text-align: left;"><strong>Funding for Mental Health</strong></p>
<p style="text-align: left;"><strong>Q: More people are seeking mental health services, yet funding is being cut.</strong></p>
<p style="text-align: left;"><strong>A:</strong> Mental health sector’s woes are being exacerbated by financial circumstances. We know the situation is dire — NY State is leading other states in home foreclosures. We have tried not to cut any essential services to mental health community. We are looking to keep the department employee cuts in the different dept. Want to make Timothy’s Law permanent [Timothy’s Law prevents discrimination by prohibiting insurance companies from limiting coverage for mental illness].</p>
<p style="text-align: left;">
<p style="text-align: left;"><strong>Your Accomplishments</strong></p>
<p style="text-align: left;"><strong>Q: As the first African American Governor, what is your best accomplishment, or legacy?</strong></p>
<p style="text-align: left;"><strong>A:</strong> That I am still alive (laughter). We passed a bigger, better, bottle bill for the next generation – it was passed 2 weeks ago. For the first time in 26 years, we have legislated the consumption of alcohol. (Does anyone know what he is referring to here?) We have increased the number of women-owned businesses firms that meet the threshold for procurement from 2% to 29%. Now 25% of the firms we do business with are women owned. For minorities, the percentage increased from 2.5% to over 20%.</p>

										<content:encoded><![CDATA[<p style="text-align: left;">A recent article in <em>The New York Times</em>, <a href="http://www.nytimes.com/2009/03/17/nyregion/17charities.html?scp=1&amp;sq=Charities%20give%20to%20state%20campaigns&amp;st=cse">Charities Give to State Campaigns, Despite Law</a>, described how some nonprofits had purchased tickets to fundraising dinners for elected officials, or had otherwise contributed to their campaigns, in violation of the law. Neither party seemed to care or take responsibility, pushing off oversight to the IRS. The article acknowledged that minor amounts entailed, and yet found it fit to disparage nonprofits on the front page.</p>
<p style="text-align: left;">I find this quite disturbing for a number of reasons.</p>
<p style="text-align: left;"><span id="more-19081"></span></p>
<p style="text-align: left;">First, given the monumental financial malfeasance wrought by the financial sector, the palty sums were elevated to front page status bring a negative light to a sector that comprises 10% of the GDP. This coverage failed to provide any context for the amounts and thus conveys a negative impression of the entire nonprofit community.</p>
<p style="text-align: left;">Secondly, as admitted in the story, most contributions were in the form of tickets to events, not directly to campaigns, with no pro quid pro expected. These types of donations were not given with malicious intent. While explicitly stating this, the tone of the article harms the reputation of hard-working organizations doing the public good.</p>
<p style="text-align: left;">If we were to look at this issue clearly, we would see that is unfair to restrict nonprofits&#8217; ability to contribute because of their nonprofit status while businesses that receive tax breaks and other preferential treatment from government have no such restrictions.</p>
<p style="text-align: left;">In fact, is the nonprofit sector that is effectively doing the government&#8217;s job of providing essential social services and a safety net, largely on private funds. If anything, nonprofits should have more of a say in how the government operates, specifically, on budget issues in which it ends up bearing the brunt of the burden as social services are slashed. Instead, businesses are allowed to lobby to receive tax breaks and other incentives while flouting financial, health, environmental and worker safety laws. Clearly, a double standard is in place.</p>
<p style="text-align: left;"><span style="color: #ff0000;"><strong>WAKE UP CALL:</strong> It is time for fair coverage and representation of the nonprofit sector in the media and halls of government. Nonprofits, now is the time to speak up!</span></p>
